Imam who lied on immigration papers suing FBI, Border Protection

Battling a government bid to deport him, the spiritual leader of one of New Jersey’s largest and most diverse mosques is suing the FBI and the U.S. Customs and Border Protection agency to force the release of any records that could bear on his ability to remain in his adopted homeland.

Mohammad Qatanani, who for the past 16 years has served as imam of the Islamic Center of Passaic County in Paterson, filed the suit in U.S. District Court in Newark on Friday under the Freedom of Information Act.

The suit claims the Departments of Justice and Homeland Security, of which the FBI and Customs and Border Protection are components, have stonewalled his requests for records for more than five months. The suit seeks to compel the agencies to immediately search for and disclose any and all records pertaining to him.

“The defendants have failed to produce even a single responsive document, or provide any other substantive response,” the complaint said, calling it “a flagrant violation” of the FOI Act, which mandates prompt adjudication of requests within 20 days of receipt and even faster action, within 10 days, for requests seeking expedited processing.

The imam’s immigration attorney, Claudia Slovinsky of New York, had requested the records in January and asked that his applications be handled on an expedited basis in light of the pending removal proceedings.

An immigration judge ruled in Qatanani’s favor in 2008, ordering that he be granted permanent resident status. The government appealed, and the case was sent back in 2009 for further fact-finding. A hearing is currently scheduled for Nov. 26.

The Department of Homeland Security alleges that Qatanani once had links to Hamas, a Palestinian political group that the U.S. government has designated as a terrorist organization, and that he lied on an immigration application by failing to disclose that he had been arrested and convicted by the Israelis when he visited the West Bank in 1993.

Qatanani has denied ever having links to Hamas. He acknowledged to U.S. authorities that he had been detained by the Israelis in 1993, but said that they had never charged him with anything and never convicted him.

Experts on the Israeli judicial system testified in Newark that Israel used to routinely detain Palestinian men without charges and argued Qatanani never would have been released after only three months if the Israelis had truly believed he had an association with Hamas.

Immigration Judge Alberto Reifkohl ruled that the government failed to prove its allegations, and granted Qatanani permanent U.S. residency. On appeal, however, the Board of Immigration Appeals sent the case back to the judge, saying that he should accept the evidence that the government submitted. The board also said that Qatanani should prove that he did not have links at the time to Hamas.

The U.S. Attorney’s Office, which represents federal agencies, declined comment saying it had not yet been served with the complaint.

He was detained as in arrested. And therein lies the problem. He lied on his immigration papers. Deport him and his family. ASAP. Chris Christie has given the lying imam his full support as we noted years ago:

“My view is he’s always had a very good relationship with us, and he’s a man of great goodwill,” Christie said Wednesday before exchanging traditional cheek-kiss greetings with Qatanani and wishing him well.

Riefkohl also noted that Qatanani has received support from U.S. law enforcement officials. One supporter, U.S. Attorney Christopher Christie, was among several high-ranking law enforcement officials who attended a Ramadan fast-breaking celebration at the Paterson mosque.
