Based on several Ahadith, Muhammad married Aisha when she was six years old and they consummated the marriage when she was nine. Muhammad was 51/54 at the time of the marriage.
Sahih Bukhari 7:62:88
Volume 7, Book 62, Number 88:
The Prophet wrote the (marriage contract) with ‘Aisha while she was six years old and consummated his marriage with her while she was nine years old and she remained with him for nine years (i.e. till his death).
One of the apologetic arguments that Muhammad was not a pedophile was that he only had one child-marriage, but this shows that he was considering a 2nd.
In the Sirat Rasul, we read the incredible story that Muhammad, himself, wanted to marry a crawling baby girl a few years before his death. This happened after he married A’isha. The following citation is from the book of Sirat Rasul Allah by Ibn Ishak, the most authentic biographer of Muhammad. Most other biographies are based on this monumental work by Ibn Ishak/Ibn Hisham
(Suhayli, ii.79: In the riwaya of Yunus I. I recorded that the apostle saw her (Ummu’l-Fadl) when she was baby crawling before him and said, ‘If she grows up and I am still alive I will marry her.’ But he died before she grew up and Sufyan b. al-Aswad b. Abdu’l-Asad al-Makhzumi married her and she bore him Rizq and Lubaba….(ref.10, p. 311)
Elsewhere, we note that even Hazrat Omor or Umar (spelling variation) married Umm Kulthum, the four year old half-sister of Bibi A’isha!
Apologists have argued that Aisha was a scholar to justify Muhammad’s marriage to a six-year-old. Such arguments imply that Allah was incapable of finding another way to spread Islam than for Muhammad to marry Aisha.
We do not abrogate a verse or cause it to be forgotten except that We bring forth [one] better than it or similar to it. Do you not know that Allah is over all things competent?
Sexual intercourse by an adult with a person below a statutorily designated age.
The criminal offense of statutory rape is committed when an adult sexually penetrates a person who, under the law, is incapable of consenting to sex. Minors and physically and mentally incapacitated persons are deemed incapable of consenting to sex under rape statutes in all states. These persons are considered deserving of special protection because they are especially vulnerable due to their youth or condition.
Most legislatures include statutory rape provisions in statutes that punish a number of different types of sexual assault. Statutory rape is different from other types of rape in that force and lack of consent are not necessary for conviction. A defendant may be convicted of statutory rape even if the complainant explicitly consented to the sexual contact and no force was used by the actor. By contrast, other rape generally occurs when a person overcomes another person by force and without the person’s consent.
The actor’s age is an important factor in statutory rape where the offense is based on the victim’s age. Furthermore, a defendant may not argue that he was mistaken as to the minor’s age or incapacity. Most rape statutes specify that a rape occurs when the complainant is under a certain age and the perpetrator is over a certain age. In Minnesota, for example, criminal sexual conduct in the first degree is defined as sexual contact with a person under thirteen years of age by a person who is more than thirty-six months older than the victim. The offense also is committed if the complainant is between thirteen and sixteen years old and the actor is more than forty-eight months older than the complainant (Minn. Stat. Ann. § 609.342 [West 1996]).
Statutory rape laws are based on the premise that until a person reaches the age of majority, that person is legally incapable of consenting to sexual intercourse. Statutory rape was codified into English law more than 700 years ago when it became illegal “to ravish,” with or without her consent, a “maiden” under the age of 12. During the 19th century, states in this country gradually raised the age of consent, in some cases to 21. Today, the age of consent ranges from 14 to 18 years of age, although in more than half of the states the age of consent is 16. The primary intention of statutory rape laws is to protect teenage girls and, recently, boys as well, from being sexually preyed upon by adults. By design, the laws are meant to deter and punish adults who have sex with minors. By definition, these laws are targeting non-forcible sexual activity. The age of consent in Massachusetts is 16 years old. States and counties are generally not pursuing teenage “lovers” who are close in age. Instead, law enforcement agencies typically prosecute statutory rape cases only when there is an age gap of 3 or more years between the minor and their partner.
Pedophilia or paedophilia is a psychiatric disorder[*] in which an adult or older adolescent experiences a primary or exclusive sexual attraction to prepubescent children, generally age 11 years or younger; as a medical diagnosis, specific criteria for the disorder extends the cut-off point for prepubescence to age 13. A person who is diagnosed with pedophilia must be at least 16 years of age, but adolescents who are 16 years of age or older must be at least five years older than the prepubescent child before the attraction can be diagnosed as pedophilia.
Pedophilia has a range of definitions, as found in psychiatry, psychology, the vernacular, and law enforcement. The International Classification of Diseases (ICD) defines it as a “disorder of adult personality and behaviour” in which there is a sexual preference for children of prepubertal or early pubertal age. It is termed pedophilic disorder in the Diagnostic and Statistical Manual of Mental Disorders (DSM-5), and the manual defines it as a paraphilia in which adults or adolescents 16 years of age or older have intense and recurrent sexual urges towards and fantasies about prepubescent children that they have either acted on or which cause them distress or interpersonal difficulty.
In popular usage, the word pedophilia is often incorrectly used to mean any sexual interest in children or the act of child sexual abuse. For example, The American Heritage Stedman’s Medical Dictionary states, “Pedophilia is the act or fantasy on the part of an adult of engaging in sexual activity with a child or children.” This common use sometimes conflates the sexual interest in and sexual contact with pubescent or post-pubescent minors. Researchers recommend that these imprecise uses be avoided because although people who commit child sexual abuse sometimes exhibit the disorder, many child sexual abuse offenders do not meet the clinical diagnosis standards for pedophilia and these standards pertain to prepubescents.
Pedophilia was first formally recognized and named in the late 19th century. A significant amount of research in the area has taken place since the 1980s. Although mostly documented in men, there are also women who exhibit the disorder, and researchers assume available estimates under represent the true number of female pedophiles. No cure for pedophilia has been developed, but there are therapies that can reduce the incidence of a person committing child sexual abuse. In the United States, following Kansas v. Hendricks, sex offenders who are diagnosed with certain mental disorders, particularly pedophilia, can be subject to indefinite civil commitment, under various state laws (generically called SVP laws) and the federal Adam Walsh Child Protection and Safety Act of 2006. At present, the exact causes of pedophilia have not been conclusively established. Research suggests that pedophilia may be correlated with several different neurological abnormalities, and often co-exists with other personality disorders and psychological pathologies. In the contexts of forensic psychology and law enforcement, a variety of typologies have been suggested to categorize pedophiles according to behavior and motivations
Sura 65:4 shows that the Qur’an allows a girl that hasn’t yet menstruated to be divorced, implying that such a girl could be married. Given that the Qur’an doesn’t forbid child-marriage and that Islam encourages following Muhammad’s example, child-marriage is supported by Islam.
And those who no longer expect menstruation among your women – if you doubt, then their period is three months, and [also for] those who have not menstruated. And for those who are pregnant, their term is until they give birth. And whoever fears Allah – He will make for him of his matter ease.
“Understanding the Hadith: the sacred traditions of Islam” by Ram Swarup discusses some of Muhammad’s marriages:
Muhammad’s wars and raids not only fed his coffers, they also swelled his harem. Safiyya, a beautiful girl of seventeen years, was the wife of the chief of a Jewish clan inhabiting Khaibar. Muhammad’s custom was to make surprise attacks. Khaibar was invaded in the same fashion. Anas narrates [Sahih Muslim 4438]: “We encountered the people at sunrise when they had come out with their axes…..”
In any case, many people were butchered, and many others were taken prisoners. “We took Khaibar by force, and there were gathered the prisoners of war,” according to Anas. Safiyya, the daughter of Huyayy b. Akhtab, the chief of the Quraiza and al-Nazir was one of them. Her husband, Kinana, was put to a cruel death [**] … Anas adds that people “praised her in the presence of Allah’s messenger and said: ’We have not seen the like of her among the captives of war’” (SM: 3329). Muhammad…even took her to his bed the same night her husband was killed, in violation of his own command, which enjoined the believers to wait until the beginning of the next menstrual cycle in their captive women. Kinana (Safiyya’s husband) was tortured in order to make him reveal his hidden treasure. “Torture him until you extract what he has,” Muhammad ordered al-Zubayr b. al-Awwam. The latter “kindled a fire with flint and steel on his chest until he was nearly dead. Then the apostle delivered him to Muhammad b. Maslama and he struck off his head” (Sirat Rasul Allah p 515). …
When the prophet was passing the night with Safiyya in a tent, Abu Ayyub took it upon himself to guard him. In the morning, Muhammad saw him and asked him what he was doing there. He replied: “I was afraid for you with this woman for you have killed her father, her husband, and her people…” (Sirat Rasul Allah p517)
Safiyya was no exception. Many other women…were taken in and treated as part of the war booty. Rihana was a Jewish girl of the Banu Quraizah. After her husband was beheaded in cold blood along with eight hundred other male members of her tribe in the genocide at Medina, Muhammad kept her as his concubine.
[Editor’s Note: This does not necessarily entail the beliefs, thoughts, or theories of the local Act chapters or the National Act office…they are my beliefs, thoughts and/or theories. [*] Contrary to what the psychiatric definition about it being solely a mental disability, it is also drilled into Muslim’s heads as a brainwashing because they want to mimic and be exactly like Mohammed.
Book 008, Number 3325:
Anas (Allah be pleased with him) reported that Allah’s Messenger (may peace be upon him) set out on an expedition to Khaibar and we observed our morning prayer in early hours of the dawn. The Apostle of Allah (may peace be upon him) then mounted and so did Abu Talha ride, and I was seating myself behind Abu Talha. Allah’s Apostle (may peace be upon him) moved in the narrow street of Khaibar (and we rode so close to each other in the street) that my knee touched the leg of Allah’s Apostle (may peace be upon him). (A part of the) lower garment of Allah’s Apostle (may peace be upon him) slipped from his leg and I could see the whiteness of the leg of Allah’s Apostle (may peace be upon him). As he entered the habitation he called: Allah-o-Akbar (Allah is the Greatest). Khaibar is ruined. And when we get down in the valley of a people evil is the morning of the warned ones. He repeated it thrice. In the meanwhile the people went out for their work, and said: By Allah, Muhammad (has come). Abd al-‘Aziz or some of our com- companions said: Muhammad and the army (have come). He said: We took it (the territory of Khaibar) by force, and there were gathered the prisoners of war. There came Dihya and he said: Messenger of Allah, bestow upon me a girl out of the prisoners. He said: Go and get any girl. He made a choice for Safiyya daughter of Huyayy (b. Akhtab). There came a person to Allah’s Apostle (may peace be upon him) and said: Apostle of Allah, you have bestowed Safiyya bint Huyayy, the chief of Quraiza and al-Nadir, upon Dihya and she is worthy of you only. He said: Call him along with her. So he came along with her. When Allah’s Apostle (may peace be upon him) saw her he said: Take any other woman from among the prisoners. He (the narrator) said: He (the Holy Prophet) then granted her emancipation and married her. Thabit said to him: Abu Hamza, how much dower did he (the Holy Prophet) give to her? He said: He granted her freedom and then married her. On the way Umm Sulaim embellished her and then sent her to him (the Holy Prophet) at night. Allah’s Apostle (may peace be upon him) appeared as a bridegroom in the morning. He (the Holy Prophet) said: He who has anything (to eat) should bring that. Then the cloth was spread. A person came with cheese, another came with dates, and still another came with refined butter, and they prepared hais and that was the wedding feast of Allah’s Messenger (may peace be upon him)]
