Alabama Men Arrested on Terrorism Charges

MOBILE, AL—U.S. Attorney Kenyen R. Brown of the Southern District of Alabama and Stephen E. Richardson, Special Agent in Charge of the Mobile Division of the FBI, announced that Mohammad Abdul Rahman Abukhdair, 25, and Randy Wilson, also known as Rasheed Wilson, 25, both U.S. citizens living in Mobile, were arrested today on terrorism charges filed in the Southern District of Alabama.

A criminal complaint signed on December 10, 2012, charges Abukhdair and Wilson with conspiring to provide material support to terrorists, knowing or intending that it be used in preparation for, or in carrying out a conspiracy to kill persons or damage property outside the United States. The complaint also charges Abukhdair with passport fraud. According to the complaint, the charges stem from Wilson and Abukhdair’s conspiracy to travel from the United States to Mauritania intending to prepare to wage violent jihad.

Abukhdair and Wilson were the subjects of an investigation by the Joint Terrorism Task Force of the Mobile Division of the FBI. Wilson was arrested this morning in Atlanta attempting to board a flight that would ultimately take him to Morocco. Abukhdair was arrested in Augusta, Georgia, at a bus terminal. According to the complaint, Abukhdair was scheduled to fly to Morocco from outside the United States on December 13, 2012.

The complaint alleges that Wilson and Abukhdair met online in 2010. On August 27, 2011, an FBI undercover employee met Wilson, and Wilson told the FBI employee that he and Abukhdair had formulated a plan to travel together overseas for the purpose of waging violent jihad prior to Wilson meeting the FBI employee, according to the complaint. In preparation for their travel, Abukhdair applied for a new passport and falsely claimed that his previous passport had been misplaced, according to the complaint. In fact, the complaint alleges, Abukhdair was concerned that Egyptian stamps in his passport might raise suspicions and impede his travel plans.

The complaint further alleges that in July 2012, Wilson and Abukhdair also began meeting with a confidential source working for the FBI, and that Wilson and Abukhdair brought the source into their plans to travel overseas to wage violent jihad. According to the complaint, Abukhdair and Wilson planned to travel to Casablanca, Morocco, and from there to Mauritania, where they expected to be in a position to wage violent jihad in a nearby country or conflict.

U.S. Attorney Brown stated, “The top priority of the Department of Justice nationally, and the U.S. Attorney’s Office locally, is to deter, disrupt, and prevent acts of terrorism. We will continue to defend our nation against anyone who seeks to harm us by investigating and prosecuting national and international terrorist plots. The law enforcement actions of today should send a clear warning to those who would consider engaging in violent jihad, either at home or abroad, that their future is bleak: they may end up in a U.S. prison cell or a casualty on a foreign battlefield. This case should also generally serve as a reminder to all Americans to remain vigilant against terror threats. Thanks to the excellent work of the Joint Terrorism Task Force, any threat posed by these individuals has been prevented.”

FBI Special Agent in Charge Richardson stated: “The efforts of the FBI’s Joint Terrorism Task Force in this investigation represent our unwavering commitment to protect the United States against terrorist attacks domestically and abroad. Our resolve to protect our family, friends, neighbors, and community ensures that we work diligently using every resource available to identify, disrupt, and dismantle extremists who desire to do us harm.”

The Joint Terrorism Task Force of the Mobile Division of the FBI conducted the investigation and presented the case for prosecution to the U.S. Attorney’s Office. Assistant U.S. Attorneys Christopher Bodnar and Sean P. Costello and Trial Attorneys Clement McGovern and Annamartine Salick of the Department of Justice’s Counter-terrorism Section are handling the prosecution of the case on behalf of the United States.

A complaint is a determination by a U.S. Magistrate Judge that there is probable cause to believe that offenses have been committed by a defendant. A defendant, of course, is presumed innocent until and unless he or she is proven guilty at trial.

[Editor’s Note: Once again this is my note and does not necessarily portray the feelings of ANY LOCAL ACT for AMERICA nor the national office, just my feelings…the FBI did a good job, and their priority is a great priority (stopping and preventing terrorism), however; they seem to be off a little. Wisconsin: Muslim hits man on the head with tire iron for insulting Islam


 

At least he didn’t behead him. He must be a moderate. “Wausau Man Attacked With Tire Iron,” from WSAU.com, October 8 (thanks to The Religion of Peace):

Wausau, WI (WSAU) A man was attacked on Wausau’s east side on Friday afternoon during a reported argument over religion. Witnesses to the attack in the 600 block of Jefferson Street say a man got out of his vehicle, accosted the victim and claimed he had criticized his Muslim religion. The victim denied it but was struck in the head with a tire iron. The attacker then escaped in his vehicle.

Wausau police say the victim knew the attacker but no arrest has been made as of yet. The attack remains under investigation.

The victim better be careful. Pretty soon he could end up being investigated for “Islamophobia.”

Under relentless pressure from Muslim Brotherhood front group CAIR (Council on Islamic-American Relations) and the Obama Regime, the Federal Bureau of Investigation will discontinue a lecture series that taught counter-terrorism agents that mainstream Muslims are violent.

The move comes after leaked documents revealed the controversial elements in the FBI’s training manuals. According to the FBI documents: most American Muslims are likely to be sympathizers to “terrorist” groups like al-Qaeda. Spencer Ackerman, the journalist who broke this story for the website Wired dot com, told Al-Jazeera why the FBI teachings are “constitutionally dicey”.  “There is still a real ignorance and to some degree a real fear of Islam that has found a surprising home in the FBI,” he said. “If they spend their time and resources going after indicators of violent behavior based on the amount of religiosity a person displays, then first of all they are not going to get actual terrorists, but innocent people.”

The area also includes two luxury apartment high-rises that erupted into cheers when the World Trade Center fell on 9/11. Law enforcement has dubbed them the “Taliban Towers.” Investigators routinely find posters and computer screen savers celebrating Osama bin Laden as a hero.

Down the street is a Saudi charitable front for al-Qaida once run by bin Laden’s nephew. The U.S. branch of the dangerous Muslim Brotherhood is in the same office park. Farther down in Alexandria is the Saudi madrassa that’s graduated several terrorists, including the al-Qaida operative who plotted to assassinate President Bush.

In reality, hate crimes against Muslims are infrequent:

And so in order to deflect attention away from jihad activity and try to portray Muslims as victims, so as to shame non-Muslims into not investigating or even being suspicious of further jihad activity, Islamic supremacist groups have resorted to making it up. Hamas-linked CAIR and other Muslims have not hesitated to fabricate “hate crimes.” CAIR and other groups like it want and need hate crimes against Muslims, because they can use them for political points and as weapons to intimidate people into remaining silent about the jihad threat.

And so if they can’t find enough real stories to fill out this new website, they can always call on a few novelists.

(CNN) – Showcasing alleged hate crimes, physical threats and profiling, a diverse group of ethnic organizations has coalesced to bring attention to what they call discrimination against Arabs, Muslims, Sikhs and others in the wake of the September 11, 2001, terrorist attacks.

The project, titled “Unheard Voices of 9/11,” officially launched online Friday with a call for people to share their experiences about being discriminated, targeted and demoralized because of their spiritual and cultural beliefs. […]

Some memories posted on http://unheardvoicesof911.org/ are from the days immediately after the attacks. Within six days of the attacks, the FBI reported that it initiated 40 hate crime investigations into alleged murders, attacks and arson directed at Americans who are Muslims, South Asians and Arabs. […]

Rabia Sajid described a man pulling up in a car in New York and yelling, “Go back to your country, otherwise I’m going to kill you.” She said the pastor of a church where she was being tutored, and later police, suggested the best thing to do was not wear her Muslim headscarf so she wouldn’t be targeted – something her parents likewise promoted, for her safety.

The New York resident, who is affiliated with the South Asian Youth Action group, said one of her biggest regrets is that she and others took that advice – not wearing clothing that was part of her Muslim heritage, for fear of being discriminated against.

“We didn’t face the problem, but we were running away from it by trying to change our identity and who we are,” Sajid said at an August hearing in New York City, portions of which are now on the “Unheard Voices” website. “We don’t know how to face the problem … I don’t know what we can do.”

There have been several high-profile cases of alleged hate crimes and cases in which Muslims and Sikhs faced opposition to projects due to their religion and heritage.

One that received significant international attention was Park 51, an Islamic community center proposed for two blocks from ground zero in Lower Manhattan. Many city residents opposed the effort, characterizing the location of the center – which would mostly house cultural, social and recreational programs, as well as a prayer space – as inappropriate given lingering feelings about Muslim militants’ role in the 9/11 attacks. Whatever CNN says, opposing the Islamic supremacist victory mosque at Ground Zero is not a hate crime.

Anoop Prasad, a northern California resident who works for the Asian Law Caucus, said he’s known many people who have been visited in recent years by FBI agents, claiming that such treatment sows widespread distrust against authorities among Muslims and others.

“In my community, people are very afraid – that’s the reality,” he said.

You’d think non-Muslims would be afraid. There was Naser Abdo, the would-be second Fort Hood jihad mass murderer; and Khalid Aldawsari, the would-be jihad mass murderer in Lubbock, Texas; and Muhammad Hussain, the would-be jihad bomber in Baltimore; and Mohamed Mohamud, the would-be jihad bomber in Portland; and Nidal Hasan, the successful Fort Hood jihad mass-murderer; and Faisal Shahzad, the would-be Times Square jihad mass-murderer; and Abdulhakim Mujahid Muhammad, the Arkansas military recruiting station jihad murderer; Naveed Haq, the jihad mass murderer at the Jewish Community Center in Seattle; Mohammed Reza Taheri-Azar, the would-be jihad mass murderer in Chapel Hill, North Carolina; and Umar Farouk Abdulmutallab, the would-be Christmas airplane jihad bomber; or so many other jihad murderers and would-be murderers in America. Because of these Muslims and others like them, many non-Muslims are very afraid — that’s the reality.

Pro-sharia group receives $25M annually, more than all anti-jihad groups it fears…combined

However, CAP alone receives $25 million per annum, so in just two years it is in receipt of far more money than all of the “Islamophobic” groups it collectively names and condemns have made in a decade. As a 501 (3)(c) organization, CAP’s existence seems to be entirely connected to attempting to swing elections in the Democrat Party’s favor, which would appear to be a contravention of IRS guidelines.

HLF Defense Argues to Overturn Convictions

Holy Land Foundation, an unindicted criminal foundation started by the Muslim Brotherhood

NEW ORLEANS – A federal judge abused his discretion in admitting key evidence and testimony used to prove that zakat (charity) committees inside the West Bank funded by an American Muslim group were Hamas-controlled, defense attorneys argued Thursday before a three-judge appellate panel.

In November 2008, five former Holy Land Foundation (HLF) officials were convicted on 108 counts of illegally routing money to Hamas through those committees. HLF had been one of the nation’s largest Muslim charities.

In their briefs filed last October, the five defendants asked the United States Court of Appeals for the Fifth Circuit to overturn the convictions. Anonymous testimony by Israeli intelligence and military witnesses, and evidence seized from Palestinian Authority offices during an Israeli raid, are among the things the presiding judge allowed jurors to hear in error, the defendants argue in their appeals.

During Thursday’s hearing, defense attorney John D. Cline, who represents former HLF Chairman Ghassan Elashi, called the government’s case a “textbook on evidentiary error.”

One Israeli witness, identified only as “Avi,” was key to the government’s case. Avi linked together documents to show that the committees which HLF sent money to were funding Hamas.

“Avi was a critical, critical witness in this case,” Cline said. Avi linked together a volume of government documents and created an easy-to-understand narrative for the jury. “He wove that all together in a nice, neat package.”

The government’s refusal to identify Avi’s true identity hindered the defense attorneys’ ability to conduct a background investigation on the witness, Cline said. But Justice Department attorney Joseph Palmer said the Israeli witnesses’ lives could have been endangered if their identities had been disclosed in public. The defense was still able to place “Avi” in a proper context before the jury.

Avi’s cross examination “was rigorous and it was effective,” Palmer said. He pointed to a separate case upheld by the 4th Circuit, in which a police officer from El Salvador was allowed to testify as an expert on a gang called MS-13, without disclosing his identity.

Cline also criticized the court for allowing prosecutors to use Avi instead of another witness identified in a government document – retired Israeli military officer Jonathan Fighel – who could have covered the same subject as Avi.

“The government, with the district court’s blessing, made a tactical choice,” said Cline.

Cline and his colleagues also challenged the credibility of government exhibits found in the West Bank. But Appellate Judge Emilio M. Garza countered that those documents taken from Palestinian Authority (PA) offices “have a certain amount of credence.”

In his remarks during oral argument, Judge Garza noted that the documents were found at the PA headquarters in Ramallah, which was then controlled by Hamas rival Fatah. It was in Fatah’s interest to have accurate information on Hamas support. “Fatah found these documents important,” he said. “The possession of these documents [by the PA] is in and of itself important.”

Cline singled out one exhibit for its illegible signature. He also said that it had no date or letterhead, making its reliability unclear. Cline argued that under rules of evidence, the government had a “heavy burden” to show why the exhibit is reliable and relevant. Judge Carolyn Dineen King called that argument “powerful.”

The defense also took issue with the use of documents found in the homes of Hamas activists Ismail Elbarasse and Abdelhaleem Al-Ashqar. These documents are hearsay, argued defense attorneys, and date back to a time period before Hamas’ designation as a foreign terrorist organization.

One exhibit introduced during the trial was a handwritten document addressed to defendant Shukri Abu Baker, who was HLF’s chief executive. In rebuttal, Cline said that the document was simply addressed to “Shukri.”

“It could have said ‘Dear John,’ but that doesn’t mean it was written to me,” said Cline.

That evidence from the contested documents can be corroborated with other exhibits in the case, Palmer countered, such as the testimony of convicted Hamas supporter Mohamed Shorbagi, phone records showing the defendants’ personal relationships with Hamas leaders, and transcripts and documents from a 1993 Philadelphia meeting of the Palestine Committee, a U.S.-based Hamas support network.

Additionally, he argued, there is “circumstantial evidence” inside those Elbarasse and Ashqar documents themselves, such as organizational charts.

All five HLF defendants had counsel at trial. The HLF charity itself did not, however, but attorney Ranjana Natarajan filed an appeal on the charity’s behalf.

Prosecutors say that she is unable to represent the charity before the court and the appeal should be dismissed.

During the 2007 trial, Shukri Abu Baker’s attorneys dropped HLF as a client, leaving it unrepresented. That proceeding ended in a mistrial when jurors deadlocked on most counts. U.S. District Judge Jorge Solis, who presided over the 2008 trial, was never informed that HLF was not represented by any of the defense lawyers at the second trial.

Illinois Governor Appoints U.S. Muslim Brotherhood Leader To New Advisory Council

Illinois taxpayers are funding a Muslim American Advisory Council to help put Muslims in their state government! Just like Obama is unilaterally doing at the federal level.

The State of Illinois has announced the creation of its Muslim American Advisory Council that includes the Secretary-General of the Islamic Society of North America (ISNA). According to the press release:

CHICAGO – August 30, 2011. Governor Pat Quinn today named members to serve on the Muslim American Advisory Council, which will help ensure Muslim American participation in state government. Governor Quinn announced the new council during “Eid,” the close of the holy month of Ramadan. “Illinois is a diverse state, which is one of our greatest strengths,” Governor Quinn said. “There are more than 400,000 Muslims and 300 mosques within our borders, representing various racial and ethnic sects of Islam. I want to make sure that everyone has an opportunity for input in how we address issues such as education, public safety and jobs, because the strategies may need to differ based on the history, culture and needs of different communities.” The Muslim American Advisory Council will advise the Governor on ways to advance the role and civic participation of Muslim Americans in Illinois. Additionally, the council will recommend strategies to better integrate Muslims in Illinois socially, educationally, culturally and economically. The council will facilitate relationship-building in the Muslim community to achieve goals related to International Commerce in Muslim countries/communities, and identify ways to more effectively disseminate information and outreach to Muslim Americans regarding state programs and services. The council will advise the Governor on appropriate policy developments, official directives, and other issues of significance impacting Illinois’ Muslims. It will bring important faith-based issues based on factual findings to the Governor’s attention and make recommendations to address those issues. It will also strengthen communication between the state and Muslim leadership and the general community.

Included in the list of appointees is ISNA Secretary-General Saafa Zarzour who has extensive ties to the U.S. Muslim Brotherhood which a Hudson Institute report says includes ISNA as a major component. For example, Mr. Zazour is a board member and President of the Chicago chapter of the Council on American Islamic Relations (CAIR.) Investigative research posted on GMBDR has determined that CAIR had it origins in the U.S. Hamas infrastructure and documents released in the Holy Land Trial have revealed that the founders and current leaders of CAIR were part of the Palestine Committee of the Muslim Brotherhood as well as identifying the organization itself as being another part of the U.S. Brotherhood. A recent post discussed an interview with the Deputy leader of the Egyptian Muslim Brotherhood in which he confirms a relationship between his organization and CAIR.
